On January 7, 2003, 50 Cent came out with the song In Da Club. The production is done by Dr. Dre, initially the beat was given to the band D12 and then it went back to 50 Cent because the band didn't know how to use it. Fiddy's rep blames the DJ, who didn't have a clean version of the offending track. Le juge a déclaré la poursuite irrecevable car la phrase ‘’It’s Your Birthday’’ est commune et ne relève pas des droits d’auteur.  On January 21, 2006, an idiot lawsuit was started by Luther Campbell, well known for 2 Live Crew, at 50 Cent. The judge ruled the suit inadmissible because the phrase "It's Your Birthday" is common and does not fall under copyright.
